27 พ.ค. 2568 เวลา 12.00 น. มีกิจกรรม “รวมพลคัดค้าน พ.ร.บ.แรงงานอิสระ” เดินขบวนจาก BTS มหาวิทยาลัยเกษตรศาสตร์ ไปยังที่ทำการพรรคภูมิใจไทย โดยกลุ่มสหภาพคนทำงาน, กลุ่มโมกหลวงริมน้ำและองค์กรเครือข่ายแพลตฟอร์มไรเดอร์ ยื่นหนังสือข้อเรียกร้องถึงพรรคภูมิใจไทย ในฐานะพรรคร่วมรัฐบาลที่มีตำแหน่งรัฐมนตรีกระทรวงแรงงาน และดำรงตำแหน่งประธานคณะกรรมาธิการแรงงานในสภาผู้แทนราษฎร และหัวหน้าพรรคที่ดำรงตำแหน่งรองนายกรัฐมนตรี ให้ยุติการผลักดันร่าง ‘พ.ร.บ.ส่งเสริมและคุ้มครองแรงงานอิสระ พ.ศ. …’ และเรียกร้องให้ออกกฎกระทรวง เพื่อให้เกิดความชัดเจนในสถานภาพการจ้างงาน เพื่อให้แรงงานแพลตฟอร์มได้รับการคุ้มครองตามกฎหมายแรงงาน เข้าถึงสวัสดิการด้านแรงงาน
บรรยากาศช่วงตั้งขบวน ผู้สื่อข่าวรายงานว่ามีพี่น้องแรงงานภาคประชาชน โดยมีไรเดอร์จากแพลตฟอร์มออนไลน์ต่าง ๆ และภาคประชาชน ทยอยมารอเพื่อร่วมกิจกรรมบริเวณ BTS มหาวิทยาลัยเกษตรศาสตร์ ซึ่งเป็นจุดเริ่มขบวน จากนั้นขบวนจึงเริ่มออกตัวในเวลา 12.51 น. มุ่งสู่ที่ทำการพรรคภูมิใจไทย โดยมีการถือป้ายนำขบวน ส่วนไรเดอร์เคลื่อนขบวนโดยการขับรถมอเตอร์ไซค์พร้อมกับบีบแตรเพื่อเป็นการแสดงออกเชิงสัญลักษณ์ โดยพบว่ามีเจ้าหน้าที่ตำรวจมารักษาความปลอดภัยและการจราจรขณะเดินขบวนด้วย
ขบวนเดินทางมาถึงบริเวณหน้าที่ทำการพรรคภูมิใจไทยในเวลา 13.07 น. จากนั้นไรเดอร์จึงผลัดเปลี่ยนกันพูดถึงปัญหาสิทธิแรงงานของแรงงานอิสระ และแสดงออกเชิงสัญลักษณ์โดยร่วมกันตะโกน “เราไม่เอา พ.ร.บ.แรงงานอิสระ”, “ทำงานเท่ากัน คุ้มครองเท่ากัน” และมีกิจกรรมแสดงออกเป็นเพื่อแสดงความไม่พอใจร่างกฎหมายฉบับดังกล่าว โดยการเผากระดาษร่าง พ.ร.บ.แรงงานอิสระฯ
โดยในวันนี้มี ไชยชนก ชิดชอบ เลขาธิการพรรคภูมิใจไทย เป็นตัวแทนออกมารับหนังสือ ก่อนที่จะเชิญตัวแทนกลุ่มไรเดอร์จำนวน 6 คนเข้าไปพูดคุยกับเลขาธิการพรรคภูมิใจไทยถึงประเด็นปัญหา ที่ด้านในห้องประชุมพรรคภูมิใจไทย โดยในส่วนของหนังสือข้อเรียกร้องมีรายละเอียดดังนี้

เรื่อง ขอคัดค้านร่างพระราชบัญญัติส่งเสริมและคุ้มครองแรงงานอิสระและกึ่งอิสระ
เรียน นายอนุทิน ชาญวีรกุล หัวหน้าพรรคภูมิใจไทย
ตามที่กระทรวงแรงงานได้ยกร่างพระราชบัญญัติส่งเสริมและคุ้มครองแรงงานอิสระและกึ่งอิสระ ซึ่งอยู่ระหว่างการนำเสนอเข้าสู่การพิจารณาของคณะรัฐมนตรีในวาระที่สอง และจะนำเสนอต่อรัฐสภาเพื่อพิจารณาในขั้นตอนต่อไปนั้น
ข้าพเจ้าสหภาพคนทำงาน กลุ่มคนงานไรเดอร์และองค์กรแรงงานตามรายชื่อที่แนบท้ายมานี้ ได้ศึกษาทบทวนร่างพระราชบัญญัติดังกล่าวแล้ว ไม่สามารถยอมรับร่างกฎหมายฉบับนี้ได้ เนื่องจากเนื้อหาร่างกฎหมายบับนี้ไม่ได้ให้การคุ้มครองกลุ่มคนทำงานตามเจตนารมณ์ที่กำหนดไว้ในหลักการและเหตุผลของการเสนอร่างกฎหมายแต่อย่างใด โดยเฉพาะอย่างยิ่งกลุ่มแรงงานไรเดอร์ หรือกลุ่มคนงานแพลตฟอร์ม ซึ่งเป็นกลุ่มคนทำงานสำคัญในเศรษฐกิจยุคแพลตฟอร์มที่มีบทบาทในการสร้างมูลค่าทางเศรษฐกิจอย่างมหาศาลให้กับประเทศ แต่กลับมิได้รับการคุ้มครองใด ๆ แม้แต่น้อย ถือเป็นการขัดต่อเจตนารมณ์ของกฎหมายตามที่ระบุไว้ในหลักการและเหตุผลในการร่างกฎหมายฉบับนี้
แม้ชื่อของร่างกฎหมายดังกล่าวจะบ่งชี้ว่ามุ่งคุ้มครองแรงงาน แต่เนื้อในกลับไม่ได้บ่งชี้สถานะและนิยามความเป็นลูกจ้าง อีกทั้งยังไม่มีหลักประกันสิทธิขั้นพื้นฐานใด ๆ อย่างแท้จริง ไม่ว่าจะเป็นสิทธิในการมีประกันสังคม การเข้าถึงกองทุนเงินทดแทน สิทธิในการรวมกลุ่มเจรจาต่อรอง หรือหลักประกันค่าตอบแทนที่เป็นธรรมตามมาตรฐานสากล
ตรงกันข้ามร่างกฎหมายนี้ยังอาจถูกนำมาใช้เพื่อยืนยันสถานะ “ไม่ใช่ลูกจ้าง” ของแรงงานไรเดอร์ ซึ่งส่งผลให้พวกเขาไม่มีสิทธิในการเข้าถึงสวัสดิการแรงงานตามที่ควรจะได้รับ นอกจากนั้นแล้วร่าง พ.ร.บ.ฉบับนี้ยังเอื้อประโยชนให้บริษัทแพลตฟอร์มแสวงหากำไรจากแรงงานโดยไร้ความรับผิดชอบต่อแรงงานในทุก ๆ ด้าน
พรรคภูมิใจไทย ในฐานะพรรคร่วมรัฐบาลที่มีตำแหน่งรัฐมนตรีกระทรวงแรงงาน และยังดำรงตำแหน่งประธานกรรมาธิการแรงงานในสภาผู้แทนราษฎร รัฐบาลชุดปัจจุบัน นอกจากนั้นแล้วหัวหน้าพรรคยังดำรงตำแหน่งรองนายกรัฐมนตรี ซึ่งมีอำนาจและบทบาทสำคัญในการเสนอผลักดันนโยบายต่าง ๆ
ข้าพเจ้าจึงขอเรียกร้องให้ท่านพิจารณาถึงผลกระทบของร่างกฎหมายฉบับนี้อย่างรอบด้านและยุติกระบวนการผลักดันร่างพระราชบัญญัติดังกล่าวในทันที ทั้งนี้ ขอเรียกร้องให้รัฐมนตรีว่าการกระทรวงแรงงานแสดงความกล้าหาญในการทำงานเชิงรุกตามที่เคยให้สัมภาษณ์ต่อสื่อเพื่อประโยชน์ของประชาชน ดังนี้
1.ขอยุติการผลักด้นร่างพระราชบัญญัติส่งเสริมและคุ้มครองแรงงานอิสระและกึ่งอิสระ พ.ศ….
2.ขอให้รัฐมนตรีว่าการกระทรวงแรงงานออกประกาศกฎกระทรวง เพื่อรับรองสถานะของคนทำงานแพลตฟอร์มให้เป็น “ลูกจ้าง” ตามมาตรา 5 โดยอาศัยอำนาจตามมาตรา 6 แห่งพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541
3.รับประกันสิทธิในการเข้าถึงประกันสังคมมาตรา 33 กองทุนเงินทดแทน และสวัสดิการพื้นฐานอื่น ๆ เพื่อให้คนทำงานแพลตฟอร์มสามารถเข้าถึงหลักประกันสุขภาพ การชดเชยกรณีเจ็บป่วย อุบัติเหตุ หรือว่างงานได้อย่างเหมาะสมและไม่เลือกปฏิบัติ
4.สนับสนุนสิทธิในการรวมกลุ่มและเจรจาต่อรองอย่างเสรี ตามหลักการองค์การแรงงานระหว่างประเทศ (ILO) อนุสัญญาฉบับที่ 87 และ 98 เพื่อให้แรงงานสามารถรวมตัวเป็นสหภาพหรือรวมกลุ่มวิชาชีพและสามารถเจรจากับแพลตฟอร์มได้โดยไม่ต้องกังวลต่อการถูกแบนจากระบบ หรือการถูกกลั่นแกล้งในรูปแบบต่างๆ
5.กำหนดหลักประกันค่าตอบแทนที่เป็นธรรมและเพียงพอต่อการดำรงชีวิต รวมถึงกำหนดเวลาทำงานอย่างเป็นธรรม ค่าจ้างต้องไม่ต่ำกว่าค่าจ้างขั้นต่ำต่อชั่วโมง และต้องมีมาตรการป้องกันการทำงานเกินเวลาโดยไม่ได้รับค่าชดเชย ทั้งยังต้องมีการกำกับไม่ให้แพลตฟอร์มเปลี่ยน หรือลดอัตราค่ารอบ หรือค่าจ้างและหรือเงื่อนไขอื่น ๆ โดยผลการ
จึงเรียนมาเพื่อโปรดดำเนินการโดยเร่งด่วน

Riders and Civil Society March to Bhumjaithai Party to Oppose Independent Workers Bill

On May 27, 2025 at 12:00 PM, an action was held under the banner “Join the Mass Rally Against the Independent Workers Bill” The march began at BTS Kasetsart University and proceeded to the headquarters of the Bhumjaithai Party. Participants included the Workers’ Union, the Mokluang Rimnam collective, and allied platform rider organizations. They submitted a petition to the Bhumjaithai Party, a coalition partner that holds the post of Minister of Labor, chairs the Parliamentary Labor Committee, and whose party leader also serves as Deputy Prime Minister. The petition demanded an end to the push for the draft Independent Workers Promotion and Protection Bill (Independent Workers Bill) and called instead for the issuance of a ministerial regulation that would clearly establish employment status and extend labor protections to platform workers, including access to labor rights and social benefits.
In the lead-up to the march, reporters noted that riders from multiple platforms and supporters from civil society gradually gathered at BTS Kasetsart University, the assembly point. The march set off at 12:51 PM toward Bhumjaithai Party headquarters, led by a banner at the front, while riders rode motorbikes, honking horns as a symbolic act. Police officers were present to manage security and traffic along the route.
The march reached Bhumjaithai Party headquarters at 1:07 PM. There, riders took turns speaking about the denial of labor rights faced by so-called independent workers. Protesters chanted slogans such as “We reject the Independent Workers Bill” and “Equal work, equal protection.” A symbolic act of burning paper copies of the draft bill expressed their opposition.
On this day, Chaichanok Chidchob, Secretary-General of the Bhumjaithai Party, came out to receive the petition. He then invited six rider representatives into the party’s meeting room to discuss the issues. The petition submitted contained the following demands:

Subject: Opposition to the Draft Independent Workers Promotion and Protection Bill and Semi-Independent Workers Bill
To: Mr. Anutin Charnvirakul, Leader of the Bhumjaithai Party
As the Ministry of Labor has drafted the Independent Workers Promotion and Protection Bill and Semi-Independent Workers Bill, which is currently under submission for Cabinet consideration in its second reading and will subsequently be forwarded to Parliament for further deliberation,
We, the Workers’ Union, rider collectives, and labor organizations listed in the annex to this letter, have carefully reviewed the contents of the draft law. We cannot accept this bill, as its provisions do not protect workers in accordance with the stated intent and rationale of the proposed legislation.
In particular, rider workers and other platform workers—who are a crucial segment of the workforce in the platform economy and who generate enormous economic value for the country—are afforded no protection whatsoever under this draft. This stands in direct contradiction to the stated principles and rationale upon which the bill was introduced.
Although the title of the draft law suggests that it aims to protect workers, its content fails to define or recognize the status of workers as employees. It provides no guarantees of fundamental rights—such as the right to social security, access to the Workmen’s Compensation Fund, the right to organize and bargain collectively, or guarantees of fair remuneration in line with international standards.
On the contrary, this draft bill could be used to reinforce the status of riders as “non-employees,” thereby excluding them from labor protections and social benefits to which they are rightfully entitled. Moreover, the draft bill openly serves the interests of platform corporations, enabling them to extract profit from workers while evading any responsibility for their rights and protections.
As a coalition partner, the Bhumjaithai Party holds the position of Minister of Labor, as well as the Chair of the Parliamentary Labor Committee. In addition, the party leader also serves as Deputy Prime Minister, a role with significant authority and influence in shaping and advancing national policy.
I therefore call upon you to consider the wide-ranging negative impacts of this draft law and to immediately halt the process of advancing the proposed legislation. Furthermore, I urge the Minister of Labor to demonstrate the courage to take proactive measures, as previously stated in media interviews, in the interest of the people. Specifically, we demand the following:
- Immediately halt the advancement of the draft Independent Workers Promotion and Protection Bill …
- Issue a ministerial regulation recognizing platform workers as “employees” under Section 5 of the Labor Protection Act (1998), by exercising authority granted under Section 6 of the same Act.
- Guarantee the right of platform workers to access Social Security under Section 33, the Workmen’s Compensation Fund, and other fundamental social benefits—ensuring equal access to health protection, compensation for illness, accidents, or unemployment, without discrimination.
- Uphold the right to organize and to bargain collectively, in line with International Labour Organization (ILO) Conventions No. 87 and No. 98. This would ensure that workers can freely form unions or professional associations and engage in negotiations with platforms without fear of being banned from the system or subjected to retaliation in any form.
- Establish guarantees for fair and sufficient remuneration, as well as just working hours. Wages must not fall below the hourly minimum wage, and safeguards must be in place to prevent excessive working hours without overtime pay. In addition, measures must be enforced to prohibit platforms from arbitrarily altering or reducing per-delivery rates, wages, or other working conditions to the detriment of workers.
We therefore respectfully urge you to take immediate action.
