ไรเดอร์ค้าน พรบ.แรงงานอิสระ เรียกร้องกฎกระทรวงคุ้มครองคนทำงานแพลตฟอร์ม

วันที่ 18 เมษายน 2568 ตัวแทนสหภาพคนทำงาน, Rider Center ,สหภาพคนทำงานแพลตฟอร์มไรเดอร์-รังสิต จำนวน 12 คน เข้าพบรัฐมนตรีกระทรวงแรงงานนายพิพัฒน์ รัชกิจประการ ตามที่ได้นัดหมายแต่ติดราชการด่วน จึงได้มอบหมายให้ นางสาวบุปผา เรืองสุด รองปลัดกระทรวงแรงงาน นายมนัส โกศล ที่ปรึกษารัฐมนตรีกระทรวงแรงงาน และ หน่วยงานที่เกี่ยวข้อง 20 คน  รับฟังข้อเรียกร้องของสหภาพคนทำงาน โดยนายฉัตรชัย พุ่งพวง ตัวแทนสหภาพคนทำงาน กล่าวว่า  สหภาพคนทำงานขอคัดค้านร่าง พรบ. ส่งเสริมและคุ้มครองแรงงานอิสระของกระทรวงแรงงาน เพราะบริษัทเจ้าของแพลตฟอร์มมีผลกำไรมาก แต่คนทำงานแพลตฟอร์มไม่ได้รับการคุ้มครองแรงงาน ไม่มีกองทุนทดแทนเมื่อเกิดอุบัติเหตุ และไม่มีการประกันสังคม คนทำงานทุกคนต้องมีความเท่าเทียมกัน จึงต้องนำมาอยู่ในกฎหมายแรงงานเดียวกันให้เกิดความชัดเจน

เรวิกา น้ำใจดี แกนนำกลุ่มไรเดอร์เซ็นเตอร์ กล่าวว่า ไรเดอร์ ทำงานขับขี่บนท้องถนนต้องเจอแดด เจอฝน ทุกนาทีมีโอกาสเกิดอุบัติเหตุหรือเจ็บป่วยได้ โดยที่ไม่ได้รับเงินทดแทน และ ไม่มีหน่วยงานรัฐให้การคุ้มครอง  ส่วนสุภาภรณ์ พันธ์ประสิทธ์    ไรเดอร์หญิง พูดถึงการทำงานยาวนานชั่วโมงเพราะถูกกดค่ารอบให้ต่ำ จึงต้องทำงานให้มากขึ้น แต่ได้ค่ารอบไม่พอเลี้ยงครอบครัว ขณะที่ ร่างพรบ.แรงงานอิสระ ยังมีการเก็บเงินเข้ากองทุนอีก โดยไม่ได้ทำให้ค่ารอบเพิ่มขึ้นอย่างเป็นธรรม กระทรวงแรงงานควรใช้กฎหมายคุ้มครองแรงงานและการประกันสังคมใช้กับคนทำงานแฟลตฟอร์ม

พูลสิทธิ์ งามฤทธิ์ ตัวแทนไรเดอร์รังสิต นำเสนอว่าคนทำงานแพลตฟอร์มทำงานเสี่ยงอันตราย ทำงานยาวนานชั่วโมง แต่ได้ค่ารอบที่ต่ำ ไม่เป็นธรรมอย่างมาก แต่ ร่างพรบ.แรงงานอิสระของกระทรวงแรงงานไม่ได้แก้ปัญหาในเรื่องค่ารอบที่เป็นธรรมและการทำงานเสี่ยงอันตราย โดยที่ไม่สามารถเจรจาต่อรองได้เลย

ขณะที่นายสมยศ พฤกษาเกษมสุข กล่าวว่า บริษัทเจ้าของแพลตฟอร์มมีกำไรปีละเป็นพันล้านบาท เป็นกำไรที่เกิดจากการกดขี่คนทำงานแพลตฟอร์ม มีความชัดเจนแล้วว่า เป็นนายจ้าง-ลูกจ้าง แต่กลับถูกบิดเบือนให้มีความคลุมเครือเพื่อหลีกเลี่ยงการปฏิบัติตามกฎหมายแรงงาน หากมีการคุ้มครองแรงงาน คนงานแพลตฟอร์มและไรเดอร์จะมีหลักประกันรายได้ทั้งในเรื่องค่าจ้างและค่ารอบ  มีการประกันสังคมเกิด แก่ เจ็บ ตาย ซึ่งขณะนี้มีหลายประเทศที่ให้บริษัทแพลตฟอร์มปฏิบัติตามกฎหมายแรงงาน ไรเดอร์รวมตัวเป็นสหภาพแรงงานและเจรจาต่อรองในเรื่องค่าตอบแทน ชั่วโมงการทำงาน โบนัส และสวัสดิการต่างๆที่ได้มาตรฐาน ทั้งนี้รัฐมนตรีกระทรวงแรงงานมีอำนาจตามมาตรา 6 พรบ.คุ้มครองแรงงานออกกฎกระทรวงให้เกิดความชัดเจนให้บริษัทปฏิบัติตามกฎหมายแรงงานตามข้อเรียกร้องของสหภาพคนทำงาน

นางสาวบุปผา เรืองสุด รองปลัดกระทรวงแรงงาน กล่าวว่า ร่างพรบ.แรงงานอิสระขณะนี้อยู่ในระหว่างรอบรรจุวาระการพิจารณาของคณะรัฐมนตรี ยังมีขั้นตอนผ่านสภาผู้แทนราษฎร ทำให้มีโอกาสปรับปรุงให้ดีขึ้นตามข้อเสนอของสหภาพคนทำงาน ส่วนข้อเรียกร้องครั้งนี้จะนำเสนอต่อรัฐมนตรีกระทรวงแรงงานต่อไป โดยจะเชิญตัวแทนไรเดอร์และสหภาพคนทำงานมาร่วมการพูดคุยพร้อมกับกลุ่มไรเดอร์กลุ่มอื่นๆต่อไป

ในนามเครือข่ายขบวนแรงงานเพื่อประชาธิปไตย ธุรกิจแพลตฟอร์มเจริญเติบโตรวดเร็วทำกำไรมหาศาล มีเจ้าของแพลตฟอร์ม หลากหลายสินค้าและบริการที่เป็นที่รู้จักกันดีเช่น Grab, Line Man, Foodpanda  ,มีการจ้างงานไรเดอร์กว่า 500,000 คน และแรงงานแพลตฟอร์มทั้งหมดกว่า 1.2 ล้านคน ซึ่งเป็นส่วนสำคัญต่อการเจริญเติบโตทางเศรษฐกิจของประเทศ    ทั้ง ๆ ที่ปรากฏชัดเจนในสถานะภาพความเป็นลูกจ้างและนายจ้าง แต่กลับถูกบิดเบือนเพื่อให้บริษัทเจ้าของแพลตฟอร์มไม่ต้องรับผิดชอบต่อการปฏิบัติตามกฎหมายแรงงาน ทำให้แรงงานแพลตฟอร์มไม่มีหลักประกันรายได้และค่าตอบแทนที่เป็นธรรม เพราะได้ค่ารอบที่ต่ำ ทำงานยาวนานชั่วโมง เสี่ยงอันตราย ไม่มีหลักประกันความมั่นคงการทำงาน ไม่ได้รับสิทธิประโยชน์กองทุนทดแทนและการประกันสังคม และไม่สามารถใช้อำนาจต่อรองเจรจากับบริษทแพลตฟอร์มได้ ในขณะที่ร่างพระราชบัญญัติส่งเสริมและคุ้มครองแรงงานอิสระโดยกระทรวงแรงงานได้ทำให้คนทำงานแพลตฟอร์มไม่ได้รับการคุ้มครองตามพรบ.คุ้มครองแรงงาน  ไม่มีการป้องกันอันตรายจากการทำงานและไม่ได้กองทุนเงินทดแทน  ไม่มีการประกันสังคม ไม่มีสิทธิการรวมตัวเป็นสหภาพแรงงาน และเจรจาต่อรอง ซึ่งจะทำให้คนทำงานแพลตฟอร์มทุกข์ยากเดือดร้อนแสนสาหัส ในขณะที่บริษัทเจ้าของแพลตฟอร์มทำกำไรมหาศาล          

เพื่อเป็นการยกระดับมาตรฐานแรงงานให้ดีขึ้นเช่นเดียวกับอารยประเทศทั้งหลาย สหภาพคนทำงานและกลุ่มคนทำงานแพลตฟอร์ม ไรเดอร์  จึงขอเรียกร้องดังต่อไปนี้

               1.   คัดค้านร่างพระราชบัญญัติส่งเสริมและคุ้มครองแรงงานอิสระโดยกระทรวงแรงงาน

               2.   ให้รัฐมนตรีกระทรวงแรงงานอาศัยอำนาจตามมาตรา 6 พรบ.คุ้มครองแรงงาน 2541  ออกกฎกระทรวง ให้เกิดความชัดเจนในสถานภาพเพื่อให้คนทำงานแพลตฟอร์มได้รับการคุ้มครองแรงงาน ได้สวัสดิการด้านแรงงาน  การป้องกันอันตรายจากการทำงานและประโยชน์กองทุนทดแทน  เข้าสู่มาตรา 33 ประกันสังคม รวมทั้งได้รับสิทธิเสรีภาพ   การรวมตัวเป็นสหภาพแรงงานและการเจรจาต่อรองตามกฎหมายแรงงานสัมพันธ์

               3. เราต้องการให้คนทำงานทุกคนมีชีวิตที่ดี มีมาตรฐานเท่าเทียมกัน ผ่านกฎหมายแรงงานที่ไม่แบ่งแยกและลดทอนสิทธิแรงงาน

Riders Oppose Independent Workers Bill, Demand Ministerial Regulation to Protect Platform Workers

Representatives from the Workers’ Union, Rider Center, and the Platform Riders’ Union–Rangsit, numbering 12 persons, attended the Ministry of Labor as scheduled. Although the Minister of Labor was absent due to urgent duties, he delegated Ms. Buppha Rueangsut, Deputy Permanent Secretary of the Ministry of Labor, Mr. Manas Kosol, Advisor to the Minister of Labor, and 20 other relevant officials to hear the workers’ demands.

Mr. Chatchai Phungphuang, representing the Workers’ Union, stated that the union rejects the draft Independent Workers Promotion and Protection Bill (Independent Workers Bill) proposed by the Ministry of Labor. Platform companies are reaping massive profits, yet platform workers remain excluded from labor protection. They have no compensation fund in case of accidents and no access to social security. All workers must be treated equally; they must fall under the same labor law to guarantee clear and enforceable protection.

Rewika Namjaidee, leader of Rider Center, emphasized that riders spend their working lives on the road, exposed to sun and rain, facing the risk of accidents or illness at any moment. Yet they receive no compensation, and no state agency provides protection.

Suphaporn Phanprasit, a woman rider, described the long working hours riders are forced to endure because companies push down per-delivery rates. Riders must work more to survive, yet earnings are still insufficient to support their families. The draft Independent Workers Bill even requires additional contributions to a fund, without delivering fair increases in pay rates. The Ministry of Labor should instead enforce the Labor Protection Act and Social Security Act for platform workers.

Phulsit Ngamrit, representing Rangsit riders, added that platform workers face dangerous work, long hours, and unfairly low pay. Yet the draft Independent Workers Bill does not address fair pay or dangerous working conditions, nor does it grant the power to negotiate with companies.

Mr. Somyot Pruksakasemsuk stated that platform companies earn billions of baht in profit annually—profits built directly on the exploitation of workers. It is clear that the relationship is one of employer and employee, yet companies and policymakers distort it to create ambiguity and avoid labor-law obligations. If labor protection is applied, platform workers and riders would be guaranteed income security through wages and per-delivery payments, as well as social security coverage for sickness, injury, disability, old age, and death. Many countries already require platform companies to comply with labor law, where riders have formed unions and successfully bargained over wages, working hours, bonuses, and social benefits. The Minister of Labor holds the authority under Section 6 of the Labor Protection Act to issue ministerial regulations that clarify this relationship and require companies to comply with labor law, in line with workers’ demands.

Deputy Permanent Secretary Buppha Rueangsut responded that the draft Independent Workers Bill is currently pending inclusion on the Cabinet agenda and must later pass through the House of Representatives. This provides an opportunity for improvements based on workers’ proposals. The demands raised will be presented to the Minister of Labor, and representatives of riders and the Workers’ Union will be invited to further dialogue, alongside other rider groups.

Subject: Opposition to the Draft Independent Workers Promotion and Protection Bill and Demand for Protection of Platform Workers
To: Minister of Labor, Mr. Pipat Ratchakitprakarn

On behalf of the Network of Labor for Democracy, the platform businesses are expanding rapidly, generating enormous profits. Owners of well-known platforms such as Grab, Line Man, and Foodpanda employ over 500,000 riders and more than 1.2 million platform workers in total—an essential force behind Thailand’s economic growth.

Yet despite the obvious reality of an employer–employee relationship, this is distorted so that platform companies evade their responsibilities under labor law. Platform workers are left without guaranteed income or fair compensation. They are forced to work long hours for low per-delivery rates, exposed to dangerous conditions, without employment security, without access to compensation funds or social security, and without the right to organize unions or bargain collectively.

The draft Independent Workers Bill put forward by the Ministry of Labor entrenches this denial of protection. It excludes platform workers from coverage under the Labor Protection Act, fails to safeguard them from workplace dangers, provides no compensation fund, no social security, and no rights to unionize or collectively bargain. This would condemn platform workers to extreme hardship while platform companies continue to amass vast profits.

To raise labor standards in line with other advanced societies, the Workers’ Union and groups of platform workers and riders demand:

  1. Reject the draft Independent Workers Promotion and Protection Bill proposed by the Ministry of Labor.
  2. Invoke Section 6 of the Labor Protection Act (1998): The Minister of Labor must issue ministerial regulations clarifying that platform workers are covered by labor protection, entitled to labor rights, protection from workplace hazards, compensation funds, and inclusion in Social Security Section 33. They must also be guaranteed the rights and freedoms to unionize and collectively bargain under labor relations law.
  3. Guarantee equal standards for all workers. All working people deserve a dignified life and equal protection under a single labor law that does not divide or diminish labor rights.
